This Privacy Policy explains how the Ken Small Real Estate Team (“we,” “us,” “our”), operating under Century 21 First Canadian Corp., Brokerage, collects, uses, and protects your personal information when you use kensmall.ca (the “Site”) or work with us. When you search listings, we may collect your saved searches and favourite properties. How we use your information
We use your information to respond to your inquiries, show you relevant listings, prepare market and pricing analysis, deliver the services you request, and, with your consent, send you market updates and information about our services. We do not use your information for any purpose you have not agreed to.
Consent and your choices (CASL)
We send marketing emails only to people who have given us consent, and every email includes an unsubscribe link. You can withdraw your consent at any time by using that link or by contacting us. Withdrawing marketing consent does not affect service messages about a transaction you are already part of.
Text messages (SMS)
If you give us your mobile number and agree to be contacted by text, we may text you about buying or selling a home. Message frequency varies. Message and data rates may apply. Reply STOP at any time and the texts stop. Reply HELP for help, or call us at (226) 271-1140.
No mobile information is sold or shared with third parties or affiliates for marketing or promotional purposes. Your mobile number and your consent to be texted are used only to send you the messages you asked for. They are shared only with the service provider that delivers those messages for us, and with nobody else.
Agreeing to texts is never a condition of using this site, booking a call, or working with us. You can say no to texts and still get everything else.
Terms and Conditions
- We use SMS to confirm appointments, send reminders, and notify clients of schedule updates or important changes.
- You can cancel the SMS service at any time. Just text “STOP”. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.
- If you are experiencing issues with the messaging program, you can reply with the keyword “HELP” for more assistance, or you can get help directly at ken@kensmall.ca.
- Carriers are not liable for delayed or undelivered messages.

Cookies and tracking
The Site uses cookies to make it work, remember your preferences, and understand how visitors use it. We use Google Analytics to understand how visitors use our site. We use Follow Up Boss, our client-relationship management system, to manage and respond to your inquiries. You can control or delete cookies through your browser settings. We do not currently display a cookie consent banner.
Who we share it with
We share your information only with service providers who help us run our business, and only as needed. These may include our customer relationship management provider (Follow Up Boss), our brokerage (Century 21 First Canadian Corp., Brokerage), the Canadian Real Estate Association and REALTOR.ca through the Data Distribution Facility (DDF) that powers our listing search, and providers who deliver home inspections and warranties. We do not sell your personal information to anyone. We do not sell, rent, or share your phone number with any third party for their own marketing or promotional purposes.
Listing data (IDX and MLS)
Property listings shown on the Site are provided through the CREA DDF feed and remain the property of the listing brokerages and CREA. Listing data is for personal, non-commercial use only.
How long we keep it
We keep your personal information only as long as we need it for the purposes described here or as required by law and professional regulation. We retain your information only as long as needed to provide our services and as required by law and professional regulation.
Your rights
Under PIPEDA, you have the right to ask what personal information we hold about you, to ask us to correct it, and to withdraw your consent. To make a request, contact us using the details below. We will respond within the timelines the law requires.
How we protect your information
We use reasonable physical, technical, and organizational safeguards to protect your information, and we limit access to those who need it. No system is perfectly secure, but we work to keep your information safe.
Links to other sites
The Site may link to other websites we do not control. This Policy does not apply to those sites, and we are not responsible for their privacy practices.
Children
The Site is not directed to children under 13, and we do not knowingly collect their information.
